Mediation Information and Assessment Meetings (MIAMs) are essential for most people who need to take a separation or divorce matter to court. Mediation helps you talk matters though in a calm and practical manner. Close×Mediation with young people “ Lets Talk “ - Consulting children and young people It is not always easy to know the best way to involve your children in important decisions. Most children and young people want to feel consulted about things that directly affect them and know that their views, ideas and wishes have been taken into account. What can be hard for children however, is feeling responsible for difficult decisions required as a result of circumstances beyond their control – for example deciding contact or residence arrangements after parents have separated. “ Lets Talk “ is an opportunity for children to have a voice in the making of these decisions without being put in the position of having to choose between people they love the most. Why Consult? Parents often want to be confident that the plans they are making in mediation will work for their children. Children will often say different things to each parent, not wanting to upset anyone – some choose not to discuss how they really feel at all. It is sometime helpful for children to talk to a person who is independent but understands the situation. A mediator, or child counsellor, properly trained in consulting with children, can take on this role. When to Consult? Children’s views can be brought into your discussions at any point but we find it is often most helpful after parents have had at least some initial discussions in mediation about what they feel would work best for their children. It is often then useful to get some feedback from your children on how they view your ideas for arrangements, what would work best for them, the things that are important to them and any ideas and suggestions they may have. What is fed back to parents? We will only feed back to parents what children agree we can feed back. Like our meetings with adults everything remains confidential. Also as with adults we cannot keep confidential any information about children being, or at risk of being, harmed. In such cases we may need to inform the appropriate authorities. Who makes the decisions? We always make it very clear to children we consult that whilst their views and ideas are being sought, it is down to you as parents to make the final decisions. This gives the children a chance to be heard without being made responsible for the actual decisions. Mediation is encouraged before resorting to solicitors and courts because it is much cheaper and faster and normally results in a way forward that is fair and practical for you. Compare this with the potential cost of litigation and court which can easily run to tens of thousands per person. As a fully accredited family mediation service we take part in this scheme to enable even more families to sort out arrangements for their children without having to resort to the courts. Not all cases are eligible but if you want to sort out: a dispute/application regarding a child or a dispute/application regarding family financial matters where you are also involved in a dispute/application relating to a child You can ask us to apply for a mediation voucher for up to £500 towards the joint cost of mediation between you and the child’s other parent. The voucher can only be used to pay for a mediation session – so you will need to pay for your MIAMs meetings yourself. If we are awarded a mediation voucher – what will this mean in terms of cost? You and your ex would both need to pay for your MIAMs meeting as normal – this is £120 per person If mediation is suitable and you both agree we can apply for a voucher, we will do this on your behalf. If one is awarded to your case, your first mediation session will be covered by the voucher. This is often sufficient to resolve many disputes regarding children’s arrangements and will include a written outcome statement of any decisions you make in mediation. What if I am on a low income and cannot afford a MIAMs meeting? If you are on a very low income you may be entitled to legal aid for mediation which the government encourages you to apply for instead of the mediation voucher as this may cover even more of the costs of mediation than the voucher scheme. There doesn’t appear to be one! You will be asked to complete a short monitoring questionnaire. Completing this is optional. Your mediator will be required to provide some information about your case, such as whether you reach an agreement and whether you ask the court to formalise an agreement. The data provided will be anonymised before being used to provide information about the way in which the voucher scheme and the mediation services were used. Why apply for the voucher through us? Only FMC registered mediation services can apply for mediation vouchers so it is important that you use a service with the Family Mediation Council logo. There are a limited number of vouchers and each family can only apply for one voucher to help resolve their case through mediation. As an accredited mediator and nationally recognised trainer of mediators she had already had a number of years’ experience helping people find a solution to conflicts in the community, between individuals and with businesses and institutions. Committed to protecting the public and promoting the highest standards in mediation she was asked to take on a national role and led the College of Mediators for a number of years. The LBA Team Lorraine Bramwell Director Lorraine has nearly 30 years’ professional experience of helping people resolve disputes. She trained as a mediator in 1995 having already had a number of years working with people in dispute in a range of situations. She is accredited both as a Family and Civil and Commercial mediator and became a Legal Services Commission recognised mediator in 1998. Lorraine has successfully mediated many hundreds of cases and has resolved disputes in family, workplace, civil and commercial, education, voluntary sector and disability issues. She is an Approved Member of the College of Mediators, a member if the Civil Mediation Council and holds Family Mediation Council Accreditation. After training as a mediator she went on to volunteer with the Personal Support Unit (PSU), accompanying and supporting people who were going to court on their own. Mayesse works as a Mediator and our Mediation Coordinator and is working towards her mediation accreditation. Katherine Stylianou Accredited Mediator Katherine has been a practicing mediator since 1995, accredited in family mediation, qualified to talk to children in child inclusive mediation, and in SEN mediation. Until recently Katherine spent over 30 years as a Senior Lecturer writing, developing and leading modules in Mediation Skills, Alternative Dispute Resolution and Evidence on undergraduate and postgraduate courses. Katherine has additionally, since 2010, been training mediators in generic and family mediation skills. She is currently an advisor to the College of Mediators and has previously served on their Professional Standards Committee. Katherine has also, since 2015, been a Professional Practice Consultant, supporting and monitoring the practice of trainee and experienced mediators. Carolyn Difford Accredited Mediator Carolyn was a Family Law Solicitor in South Africa for 30 years. This background in litigation motivated her transition to mediation and her desire to assist parties make decisions regarding the restructuring of their family unit outside of the adversarial environment of the courts. Carolyn has a B.Proc Law degree and LLM specialising in Child law Carolyn trained as a Family Mediator with LBA in 2022 before joining Lorraine Bramwell Associates as a mediator. She is a member of the College of Mediators, The Family Mediation Council and the Family Mediation Association. Rochelle Graham Accredited Mediator Rochelle is an Accredited Family Mediator with the Family Mediation Council and a member of the Family Mediation Association. She is a qualified teacher who taught in both primary and secondary schools and understands the effect of divorce and separating parents on children. She has also worked in a financial consultancy and uses her financial experience in mediation. Rochelle has experience in children, property and finance and all issues cases. She has a special interest in working with parties who have applied to the Beth Din for a Gett, a Jewish divorce. She is familiar with Jewish divorce law and the Gett process and uses mediation to assist Jewish couples wishing to divorce reach an agreement in a non-confrontational manner. This assists them in obtaining both a civil and religious divorce. Rochelle also volunteers as a mediator for a local charity who provide workplace community and neighbourhood mediation.
